After pleading guilty to tax fraud charges resulting from a case regarding the company’s commercial activities, the former chief financial officer of Donald Trump’s family business will be given a five-month term.

Allen Weisselberg was charged with failing to disclose and pay taxes on a variety of fringe benefits he had allegedly received while working for the Trump Organization.

These perks included cash for travel, a rent-free apartment, pricey automobiles, private school tuition for his granddaughters, and new furnishings, among others.

It’s the kind of instance that shows how pricey gifts received by an employee may cause issues if they aren’t properly disclosed to the IRS.
A remarkable example of this is the case against Weisselberg, who admitted to taking part in the alleged tax scheme with the Trump Organization for 15 years. Weisselberg was a longtime high-ranking employee of the former U.S. president.

According to Daniel Hemel, a tax law professor at the New York University School of Law, Weisselberg’s flagrant failure to disclose benefits earned while working for Trump’s family firm made the government’s case obvious.

These are referred to as ancillary advantages, “Hemel uttered. “When it comes to reporting them, there is no grey area. Simply put, this was tax fraud.

The IRS has a whole publication devoted to reporting fringe benefits, which includes instructions on how to itemise unique employment benefits like tuition reimbursements, use of vehicles and real estate, as well as other compensation Weisselberg is alleged to have withheld or omitted while working for Trump.

TAX EVASION, SUCH AS ERRONEOUSLY CLAIMING DEDUCTIONS, CREDITS, AND CHANGES TO INCOME, IS FORBIDDEN, ACCORDING TO THE IRS:

Federal tax evasion, which is defined by the IRS as failing to declare income to the government or hiding it from it, is a felony.

Each count of tax fraud that a person is suspected of committing carries a fine of up to $250,000 or a sentence of up to five years in prison, or both, according to the IRS’ tax crimes manual. Tax evasion involves a $500,000 fine for businesses.

WEISSELBERG AVOIDED A LENGTHIER TERM OF UP TO 15 YEARS BY ENTERING A GUILTY PLEA:

Although Weisselberg may still be asked to testify in a trial against the Trump Organization in October, his plea agreement, which includes a fine of about $2 million, does not force him to assist prosecutors in their pursuit of a broader criminal case against Trump.

Weisselberg’s case, according to Hemel, was so extreme that it is unlikely to set a precedent for other tax liability cases, while the government will pursue charges against him in the hopes of discouraging other tax cheats.

This week, President Joe Biden signed the Inflation Reduction Act into law, allocating $80 billion for the IRS to spend, in part, for hiring more personnel, some of whom would aid the organisation in pursuing affluent individuals and businesses that evade paying taxes.

According to Hemel, most employees do not need to worry about disclosing fringe benefits because it is the responsibility of their employers to include them on yearly W-2 tax forms.

The majority of Americans “don’t have to worry about their employer handing them thousands of dollars in cash and not disclosing it on W-2s,” according to Hemel. The majority of us obtain a W-2 that accurately represents our tax obligations.
